Campus Events - Movies

Films and videos are generally protected under the copyright laws of the United States. A showing of them for a gathering of individuals in most cases requires the individual conducting the performance to obtain a license which in turn requires the payment of a fee. If you or any group with which you are affiliated intends to have a viewing of a movie or film, you should presume that the payment of such a fee is necessary and obtain a license to do so prior not only to the viewing of the film but to the advertising of it.

One important exception to this rule is the so called “Fair Use” exemption which, if it applies, means that the payment for the rights to exhibit the film or movie need not be made. The requirements for application of the “Fair Use” exemption are:

  1. The viewing has to be in-person (not online), in the classroom or a space devoted to instruction with the students physically present.
  2. The viewing must be made by, at the direction of, or under the actual supervision of the instructor.
  3. The viewing has to be directly related to curriculum prescribed by a professor as a regular part of the systematic mediated instruction activities, and only for students enrolled in the class in connection with their academic work.
  4. The copy of the film distributed must be legitimately owned by the person exhibiting it or otherwise lawfully in their possession.
Otherwise, a fee for the exhibition of such a film or movie will be necessary.

Please also understand that all movies exhibited on campus must fit within the Catholic, Benedictine Mission of the College.
